ARTTYZENHAUZ ONLINE STORE SERVICES PROVISION RULES:
1. Terms.
1.1. Purchase and Sale Rules – these remote goods purchase and sale contracts, which establish the rights and obligations of the Buyer and the Seller, the terms of purchase and payment for goods, the procedure for delivery and return of goods, the liability of the parties and other provisions related to the purchase and sale of goods in the www.arttyzenhauz.com online store.
1.2. Online store – an electronic store located on the www.arttyzenhauz.com website, where the Buyer, having registered and not registered with the Online Store system, can purchase goods offered by the Seller.
1.3. Seller – Arttyzenhauz, MB, registered and operating in accordance with the laws of the Republic of Lithuania, registration No. 305582244 , internet address www.arttyzenhauz.com
1.4. Buyer – a person who has purchased goods in the Online Store by purchase or gift.
1.5. Recipient – a person specified by the Buyer to whom the goods ordered by the Buyer are delivered.
1.6. Purchase and sale agreement – a contract for the purchase and sale of goods concluded between the Buyer and the Seller, consisting of an application for ordering goods, which the Buyer submits to the Seller through the Online Store.
2. The moment of conclusion of the purchase and sale agreement.
2.1. The agreement between the Buyer and the Seller is considered concluded from the moment when the Buyer, having created a shopping cart, specified a delivery address, selected a payment method and familiarized himself with our rules, clicks the “Pay now” button in the e-store.
2.2. The Agreement shall enter into force upon receipt of your payment for the goods and shall remain in force until the goods are fully delivered.
2.3. Each agreement concluded between the Seller and the Buyer is stored in the e-store.
2.4. By this Purchase and Sale Agreement, the Seller undertakes to sell and deliver the goods to the Buyer, and the Buyer undertakes to accept the goods and pay the specified amount of money for them.
3. Buyer's rights:
3.1. The Buyer has the right to purchase goods in the e-store in accordance with these rules and the procedure established by the e-store.
3.2. The Buyer has the right to withdraw from the purchase and sale agreement with the e-store, except for cases where the agreement is concluded due to: participation in games or lotteries; in other cases where the purchase and sale agreement cannot be withdrawn, in accordance with the laws of the Republic of Lithuania.
4. The Buyer undertakes to:
4.1. The Buyer must pay for the goods and accept them, unless otherwise agreed.
4.2. If the data provided in the Buyer's registration form changes, the Buyer must immediately update them.
4.3. By using the e-store, the Buyer agrees to these purchase and sale rules and must comply with them.
5. Seller's rights:
5.1. In the event of important circumstances, we may temporarily or completely terminate the e-store's operations without prior notice to the Buyer. 5.2. We may unilaterally change the terms of these rules.
6. The Seller undertakes to:
6.1. Create all conditions for the Buyer to properly use the services provided by the e-store.
6.2. Deliver the goods ordered by the Buyer to the address specified by him and within the agreed delivery period.
6.3. In the event of important circumstances, we are unable to deliver the goods ordered by the Buyer, we undertake to offer an analogous product, and if the Buyer refuses to accept the analogous product, we undertake to refund the money paid to him within 14 Business Days.
7. Delivery of Goods:
7.1. The Goods are delivered by Us or Our authorized representative (couriers).
7.2. During the delivery of the Goods, the Buyer must check the condition of the shipment together with the Seller or the Seller's authorized representative.
7.3. After you sign the Invoice or the delivery document of the shipment, it is considered that the shipment has been transferred.
7.4. If the Buyer notices damage to the shipment, he must not accept the shipment and note this on the consignment note. If the Buyer accepts the goods and signs the consignment note without comments, it is considered that the shipment has been delivered properly.
8. Return.
8.1. The return of items is carried out in accordance with the Retail Trade Rules of the Republic of Lithuania approved by Government Resolution No. 738 of 22 July 2014.
8.2. The returned item must be purchased no earlier than 14 days ago and must be in its original packaging, undamaged and unused. The Buyer is responsible for the condition of the item. If the item is not fully completed and properly packaged, the Seller or the Seller's representative will not accept the item for return.
8.3. The item must be returned in the packaging in which it was delivered. The packaging must be undamaged, clean, properly prepared and packaged.
8.4. The Buyer shall cover the costs of returning the item, except in cases where the item is returned due to poor quality of the item.
8.5. When a defective product is returned, the Seller undertakes to accept the defective product and replace it with a similar product. In the event that we do not have a similar product, we will refund you the price you paid for the product
9. Liability.
9.1. The Buyer is fully responsible for the accuracy of the data provided in the registration form. 9.2. The Buyer is responsible for the actions performed using the e-store.
9.3. The Buyer is responsible for the transfer of the identification code to third parties. If third parties use the Buyer's identification code, the Buyer is responsible for the actions performed by the third party.
10. Use and protection of personal data.
10.1. By purchasing a product in the www.arttyzenhauz.com online store, the Buyer agrees that his e-mail will be used to inform us about Arttyzenhauz news by sending newsletters. Newsletters can be unsubscribed. To stop receiving newsletters, please contact us at info@arttyzenhauz.com.
10.2. Any information related to personal data is subject to the Seller's personal data protection policy, which is regulated by the relevant Laws of the Republic of Lithuania and is implemented taking into account the recommendations of the State Data Protection Inspectorate. 10.3. The Seller does not transfer (except in accordance with the procedure established by the laws of the Republic of Lithuania) the Buyer's personal data to third parties, except for persons contributing to the execution of the order, for whom these data are necessary for the successful execution of the order (couriers).
11. GIFT COUPONS AND LOYALTY PROGRAM
11.1. The Seller has the right to sell gift coupons, for which the Buyer can purchase goods sold by the Seller. Discounts are not applied to purchased gift coupons. Gift coupons are not exchangeable for money.
11.2. When the Buyer pays for purchased goods, the value of which is less than the value of the gift coupon, with a gift coupon, the price difference is not refunded to the Buyer. When the Buyer pays for purchased goods, the value of which is higher than the value of the gift voucher, with a gift voucher, he must pay the Seller the price difference.
12. QUALITY GUARANTEE OF GOODS
12.1. The properties of each product sold in the Online Store are indicated in the product description provided on the website: www.arttyzenhauz.com
12.2. The Seller is not responsible for the fact that the color, shape or other parameters of the products in the Online Store may not correspond to the actual size, shape and color of the products due to the characteristics of the display used by the Buyer.
12.3. The Seller provides a quality guarantee for the products, the specific term and other conditions of which are indicated in the product description.
12.4. In the event that the Seller does not provide a quality guarantee for the products, the quality guarantee for such products established in legal acts shall apply.
12.5. Warranty services for goods are provided to the Buyer by the ArtTyzenHauz studio.
13. Final provisions.
13.1. Distribution of any e-store information without the written consent of the Seller is prohibited.
13.2. These rules are subject to the law of the Republic of Lithuania.
13.3. All disputes arising from the implementation of these rules are resolved through negotiations. If an agreement cannot be reached, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
